Terms and Conditions

OVERVIEW
Welcome to Atelier Europe! In these terms, “we”, “us” and “our” refer to Atelier Europe. We operate this store and website, including all content, features, tools, products and services, in order to provide you with a personalised shopping experience.

These terms and conditions, including any policies referenced herein (the “Terms of Service” or “Terms”), outline your rights and responsibilities when using the Services.

Please read these Terms carefully, as they contain important information regarding your legal rights, disclaimers, and limitations of liability.

By accessing, interacting with, or using our Services, you agree to these Terms and our Privacy Policy. If you do not agree, you are not permitted to access or use the Services.

ARTICLE 1 - ACCESS AND ACCOUNT
By agreeing to these Terms of Service, you confirm that you are of legal age in your place of residence and that you have given us permission to allow any minor family members to use the Services on devices owned or managed by you.

To use the Services, for example to visit our webshop or purchase products and services, we may ask you to provide certain information such as your email address and billing, payment and shipping details. You guarantee that all information provided is accurate, current and complete, and that you have the right to share this information.

You are responsible for safeguarding your account information and for all activity under your account. You may not transfer, sell, assign or license your account to others.

ARTICLE 2 - OUR PRODUCTS
We strive to describe our products and services as accurately as possible. However, please note that colours and appearance may vary from what you see on your screen, depending on your device and settings. We do not guarantee that the appearance or quality of the purchased products will meet your expectations or exactly match the webshop display.

Product descriptions may be changed at any time without prior notice. We reserve the right to remove any product from sale at any time and to limit quantities per person, region or jurisdiction.

ARTICLE 3 - ORDERS
When you place an order, you make an offer to purchase. Atelier Europe reserves the right to accept or reject any order at its sole discretion. Your order is only accepted once it has been confirmed and your payment has been received and processed. Please review your order carefully before submitting it.

Cancellations may not be accepted after an order has been confirmed. If we do not accept, modify or cancel an order, we will contact you via the email address, billing address or phone number provided during checkout.

Preorders
Some products may be offered as pre-orders. This will be clearly indicated on the product page.

For pre-orders, full payment is taken at the time of ordering. The product is then shipped once it becomes available. The stated delivery date is always indicative and may change depending on production, stock or logistical delays.

If an order contains both in-stock and pre-order items, the order may be shipped in multiple deliveries unless otherwise stated.

ARTICLE 4 - RIGHT OF WITHDRAWAL AND RETURNS
Consumers in the EU have the right to return a product within 14 days of receipt without giving any reason, unless the product is custom-made or clearly exempt.

Return conditions:

  • Products must be unused and in original condition
  • Items must be undamaged
  • All products must be returned in original packaging, including labels and accessories

For full return conditions, procedures and any costs, please refer to our returnpolicy

ARTICLE 5 - PRICING AND BILLING
Prices, discounts and promotions may be changed without prior notice. The price charged for a product or service is the price at the time of your order and will be confirmed in your order confirmation email. Unless stated otherwise, prices include taxes but exclude shipping costs, handling fees, customs duties and import taxes.

Displayed prices may differ from prices in physical stores or third-party websites. Promotions may affect pricing and are subject to their own terms, which take precedence in case of conflict.

You agree to provide accurate and up-to-date purchase, payment and account information and to update it promptly when changes occur.

You guarantee that:

  • credit card details are correct and complete
  • you are authorised to use the credit card
  • charges will be approved by the card issuer
  • you will pay all costs including shipping, handling and taxes

ARTICLE 6 - SHIPPING AND DELIVERY
We aim to deliver your order as quickly as possible, but we cannot guarantee exact delivery times. Delays may occur due to carriers, customs or other circumstances beyond our control. Once products have been handed over to the carrier, ownership and risk of loss pass to you.

For more details, please refer to our shipping page.

Unless expressly stated otherwise, the Services and all products are provided “as is” and “as available,” without any warranties, express or implied, including but not limited to fitness for a particular purpose, merchantability, quality, durability, title, or non-infringement. We do not guarantee that the Services will be uninterrupted, secure, or error-free. In some jurisdictions, limitations on implied warranties are not permitted; in such cases, the applicable legal requirements shall apply.

ARTICLE 13 - LIMITATION OF LIABILITY
To the extent permitted by law, Atelier Europe, our partners, employees, affiliates, representatives, Shopify and its affiliates shall in no event be liable for any direct or indirect loss, damage, or claims, including but not limited to loss of profits, loss of revenue, lost savings, data loss, or replacement costs, arising from your use of the Services or products, or any other claim related to your use of the Services or products.   1. a breach of these Terms of Service by you;
  2. a violation of any law or the rights of third parties;
  3. your use of the Services.

You must notify us of any claim in a timely manner and cooperate with our defense, for example by providing relevant documents. We may handle the defense at your expense, but we will not enter into any settlements regarding your non-monetary obligations without your consent.

ARTICLE 15 - SEVERABILITY
If any provision of these Terms of Service is found to be unlawful, void, or unenforceable, the remaining provisions will remain in full force and effect. The unenforceable provision will be deemed severable from the remaining provisions.

ARTICLE 16 - WAIVER: ENTIRE AGREEMENT
Failure to exercise or enforce any right under these Terms of Service shall not constitute a waiver of such right.

These Terms of Service, together with the policies posted on the site, constitute the entire agreement between you and us and supersede all prior agreements, whether oral or written. Any ambiguities shall not be interpreted to the detriment of Atelier Europe.

ARTICLE 17 - GOVERNING LAW
